Consent to Telehealth

Please read this Consent to Telehealth carefully before utilizing the TM Health platform and engaging in services with our affiliated medical practices and licensed healthcare providers. By clicking "I Agree" or proceeding with your consultation, You acknowledge that You have read, understand, and agree to the terms below.

1. Background and Scope of Services

• TM Health Platform: TM Health provides a technology platform and administrative support services that enable licensed, independent healthcare providers (**"Providers"**) to offer health and wellness consultations via telehealth.

• Affiliated Medical Practices: Medical services are provided exclusively by independent medical practices and their affiliated Providers, which may include physicians, nurse practitioners, or physician assistants licensed in Your state. TM Health does not provide direct medical care.

• Services Offered: Our Providers specialize in diagnosing and treating conditions related to age-management, hormone optimization, and general wellness, including but not limited to Testosterone Replacement Therapy (TRT), Body Composition Optimization, and Peptide Therapy.

• Limited Scope: You understand that the telehealth services provided by the affiliated Providers are limited to the specific services offered through the TM Health platform and do not replace Your relationship with Your primary care physician or other treating specialists.

2. Not for Emergencies

You understand that You should never use the TM Health platform in a medical or psychiatric emergency. If You are experiencing an emergency, You should immediately dial 911 or proceed to the nearest emergency department.

3. Nature of Telehealth

You understand that "telehealth" involves the delivery of healthcare services using electronic communications, information technology, and other remote means, including secure video, phone calls, text messaging, and/or asynchronous electronic messaging.

Benefits of Telehealth:

• It is convenient and affordable.

• It allows for rapid access to specialized care, such as hormone optimization and TRT.

• It allows the Provider to remotely review Your laboratory results, medical history, and assessment responses to formulate a personalized treatment plan.

Risks and Limitations of Telehealth:

• You understand there is an inherent risk that the electronic systems could fail, causing a delay in Your consultation or treatment.

• Lack of In-Person Exam: You understand that the affiliated Provider will not conduct a full in-person physical examination. The Provider will rely on the information You provide, including Your medical history, self-reported symptoms, and recent lab results. There is a risk that a physical exam might reveal a medical condition that the Provider cannot identify through a remote consultation, which could lead to a delay in diagnosis or treatment.

• Reliance on Truthful Information: The Provider is relying exclusively on the information, history, and lab results You provide. You accept greater responsibility for providing full, accurate, and truthful information about Your health, symptoms, and medical history. If You fail to do so, You increase Your risk of adverse events or receiving unnecessary or inappropriate treatment.

• Duty of Care: You understand that an affiliated Provider takes responsibility for Your care **only after** they have reviewed all submitted information, lab work, and determined that You are a suitable candidate for telehealth services. Completing the intake forms, making a payment, or scheduling a consult does not automatically create a Provider-patient relationship. The Provider reserves the right to refuse care at their professional discretion.

4. Electronic Communications and Risks to Privacy

• Electronic Health Information: You consent to the electronic storage, transmission, and processing of Your personal health information (PHI) via the TM Health platform. You understand that the electronic transmission of information, while utilizing reasonable security measures, always carries a risk of unauthorized access, interception, or disclosure.

• Communication Method: You agree to communicate with the Provider primarily through the secure messaging or telehealth platform provided by TM Health. You understand that You must check the platform regularly for important messages, lab result reviews, and follow-up instructions from Your Provider. Delays in checking messages may delay Your care.

• Privacy Policy: You have been given the opportunity to review the TM Health Privacy Policy, which details how Your health information is protected and used.

5. Risks of Treatment and Medication

• Informed Decision: You understand that all medical treatments and medications prescribed or recommended by the Provider, including those related to TRT, Peptides, or Body Composition Optimization, carry risks of serious side effects and adverse events, including but not limited to allergic reaction, permanent disability, and death.

• Your Responsibility: It is Your responsibility to make an informed decision about accepting a proposed treatment plan after weighing the risks and benefits of the medication, alternative treatment options (including no treatment), and fully reading all information provided about Your prescribed treatment.

• Pharmacy Services: You acknowledge that TM Health is not a pharmacy. Prescriptions will be sent to a licensed, third-party pharmacy for fulfillment and delivery. You understand that payment to TM Health for a consultation does not guarantee that a prescription will be written or dispensed. Medication prescribing is at the sole discretion of the affiliated Provider.

By continuing with my consultation on the TM Health platform, I confirm that:

• I have read and understand the information provided in this Consent to Telehealth.

• I understand that I am responsible for providing true, accurate, and complete information regarding my health and medical history.

• I accept the risks and limitations associated with receiving medical services via telehealth, including the absence of an in-person physical examination.

• I understand that I can ask any questions I have about these risks or the proposed treatment plan to my affiliated Provider before starting treatment.

• I have been advised that I may withhold or withdraw this consent at any time without affecting my right to future care or treatment outside of the TM Health platform.
